Exhibiting Terms & Conditions
1. Show Information
Foodex China will be held on 26-28 September, 2013 at Hangzhou Peace International Exhibition Center. It is organized by China Council for the Promotion of International Trade-Zhejiang Branch, Zhejiang Chamber of Commerce and Food & Beverage Online(21food). Co-organizer is Hangzhou Topservice Exhibition Co., Ltd. The exhibitors attending Foodex can be individual, company or relevant organization.
 
2. Application
Exhibitors who sign up for Foodex online should download the application form, fill in it, stamp official seal on it and enclose business license copy after getting organizing committee’s notice. If the exhibitor attends Foodex under empowerment, please offer original certificate of authorization from exhibitor who gives empowerment. The application form should be sent or fax to organizer and it is only valid until it is confirmed by organizer. The deadline for application is 15 September, 2013.
The exhibitors are allowed to exhibit exhibition-theme-related products only. If the exhibitor violates this term, organizer reserves the right to cancel his/her booth. Organizer is entitled to change booth location, size and exhibition hall in consideration of the general interests of exhibition. If any alteration, the organizer will inform exhibitors by confirmation letters.
 
3. Booth Construction
The exhibitors who design and build their own booths have some extra requires for booth construction can contact appointed contractor of Foodex for help. The contractor appointed by organizer and stand designer authorized by exhibitors need to pay administrative fee (Please refer to Exhibition Guide). Exhibitors shall pay organizer extra fee if they use leasing spot for booth set-up overtime.
The design scheme shall be limited by pavilion construction. For those exhibitors who set up their booths by themselves, it is applicable to make adjustments after organizer’s approval. No damage to exhibition hall is permitted when building booths. If any damage, exhibitors shall make compensation.
 
4. Payment
After having submitted application form and signed formal contract with organizer, exhibitor should make full payment within7 days.
For the exhibitors who neglect specified due date and are in arrears with payment, organizer has right to cancel his application and contract.
 
5. About cancelling booth
When exhibition is around the corner, exhibitors are not allowed to cancel, choose or reduce confirmed booths at will. If there is any exceptional case indeed, organizer may make some adjustment according to different circumstances and the additional fee should be paid by exhibitors.
The rules of dismantling booth:
(A) More than 3 months ahead of show date: 50% of the total fee
(B) (Within) 3 months before show date: 100% of the total fee
The charging standard counts from the day that organizer receives exhibitor’s letter or written notification. In addition, exhibitors shall pay any other costs which organizer has spent on them. The terms above can not be altered under any circumstances.
 
6. Transportation
a) Exhibitors are responsible for arrangements and costs of their products’ transportation.
b) Before exhibits reaching exhibition hall, exhibitors shall arrange storeroom or warehouse by themselves and meanwhile get organizer’s permission.
c) Exhibitors should timely report exhibits’ name and quantity to organizer.
d) Exhibitors are not allowed to place any exhibits outside the pavilion. Any damage of pavilion caused by exhibits shall be undertaken by exhibitors.
 
7. Safety and Insurance
The sponsor, trustee, organizer’s employees and service-offering staff and agents shall be derelict of duty for the safety of any people attending or visiting the show and has no obligation to keep their property.
Exhibitors and their booth designers shall strictly observe the rules of operations in exhibition hall and accept inspection and supervision of booth set-up by related pavilion staff. During construction period, all the regulations of safety and fire prevention in the pavilion must be abode by. Any violations are found, exhibitors will bear all the responsibility and the consequences accordingly.
Exhibitors should ensure that adequate insurance has been covered, including but not limited to finance, exhibiting items or any kind of goods against all risks; drawing up public conventions and doing well in insurance work in order to prevent any loss and damage due to fire, flood, theft, accident or other reasons in any case and prevent damage of any part of the exhibition hall caused by exhibitors, its staff, agents or contractors, or invitees. Exhibitors should ensure that the organizer shall suffer no loss or injury due to any person (including the public members or organizing staff, agents or contractors) and no financial loss arisen from any actions or faults of the exhibitors, its staff, agents or contractors, or invitees. If organizers request the certificate of insuring, exhibitor should submit them.
Exhibitors must apply third party insurance for its staff and temporary staff, service personals, agents and contractors. The period of insurance is from the day that exhibitors or any of its staff, agents and contractors enters the exhibition hall for the first time to the moment that they move out all its exhibiting products and property out of exhibition hall.
Organizer shall be no responsible for any limits or conditions of obstructing construction, installation, accomplishment, alteration or removal of booth and passageway and placing or moving exhibits in any case, nor the failure of contract of providing any services by exhibition hall owners or other third parties.
 
8. Law and Regulation
Exhibitors must unconditionally obey existing laws, terms and regulations, rules established by local government, public authorities and exhibition hall directors. Any violation, exhibitors will be immediately disqualified from attending exhibition and investigated.
Once the contract is signed by exhibitors, it means that exhibitors assure that they do not violate others’ intellectual property right for all exhibits and external packings.
 
9. Subsidiary Terms
The organizer reserves right to formulate subsidiary terms to replenish “Exhibiting Terms and Conditions” on account of new situations to make exhibitors attend show successfully. The volume of any products, booths and on -the-spot program must not exceed 70 decibel. Stereo equipment is not allowed to bring into exhibition hall. We strongly request exhibitors obey the rules above to ensure that exhibition goes well under professional and unmolested atmosphere. Organizer is entitled to take proper measures.
 
10. Violation of “Exhibiting Terms and Conditions
According to circumstances of violating any clause of “Exhibiting Terms and Conditions” and subsidiary terms, penalties will be given to exhibitors. For example, cancelation of booth, appropriate fine, no compensation or no return of exhibition fee etc.
 
11. Force Majeure
In the circumstance beyond control, organizer bear no responsibility for exhibitors: for the failure to act the obligations stated in contract wholly or partly, or any modification and alteration of exhibition rules and terms or the cancelation of exhibition or limited opening time.
